Introduction:

    The Party is the highest form of organization of the masses, which brings together the unity of will and action which are reflected in thought and politics, organization and cohesion of its ranks and discipline of all its members informed and to reject all or farm every aspect of intellectual ramblings. It is the  basic law in Our Party, Kurdistan Freedom and Justice in order to realize the hopes of our people in freedom and justice and to create a better society for our Kurdish people, it is taking into account the circumstances of our country and the characteristics of our historical, national and religious establishment.  

    Our Party is  considering itself   as Advanced factions of the national liberation movement and the national struggle against imperialism and Zionism and to protect the national gains  of our  people and expel the occupiers and the path of democracy and social progress and the struggle against all forms of oppression, exploitation and discrimination on the basis of national, religious or sectarian rid of the parasitic bureaucracy and in the community. 

    A new dawn shone on our Kurdish people  by establishing a party of freedom and justice, which bowed out in a new phase of his life in order to progress and justice in order to achieve their hopes and aspirations and failed over the mountains of Kurdistan branches high among the banners of liberty and justice away from intolerance and genetic and subjective personal beyond the scope of the national consciousness and this is the basis to build our party internal life. 

Chapter One :

Bases:

Article I: 

    Name of the party: Kurdistan Freedom and Justice party   

Article 2

    The party's headquarters: Kurdistan of Iraq, and is entitled to establish branches outside the Kurdistan Region 

Article III:  

    The party's slogan: an independent and democratic Iraq and  federal system of Kurdistan within a unified Iraq 

Chapter II  :

Membership:  

Article IV:    

      Membership in the party:  

              (*) Each Iraqi people and Iraqi Kurdish nationalism within the territory of Kurdistan    and abroad belonging to the party and is (a candidate member) if fulfills the following conditions:  

1- The age is eighteen years of age.

2 -  -submit a request requesting that belong to the party and accept employment in its ranks, according to the system and the Platform  of the Party.

3  -nominated by two members spend at least one year in the party and their membership in the party at least a year, and are responsible for recommending him for the party.

4) ) paying  monthly contributions.

5) )that does not have to belong to a political organization, party or another.

6) )with a reputable and good behavior.

7) )not be convicted of a crime involving moral turpitude.

8) )who was a member of the party or another political organization are to accept the consent of the party organization. The leadership group in other political parties should be accepted by  the central committee and the  and Politburo.

9) )to contributing by all means to the consolidation and unity of the party intellectual, political and regulatory as the main condition of the strength of the party, and stand in the face of every attempt conglomerate or divisive.

10) ) expressing his views and suggestions without hesitation in the party organization and to those organizations and levels of Party responsible.

   (  11) that make observations on the work of the party on the basis of criticism and self-criticism.

    ( 12)  the member should not criticisms and observations outside the bodies of the party and this is considering as breaching of the rules of party work and down the damage  in the party and must be held accountable.

    ( 13)  The member should be  sincere and straight with the party and not to hide the facts about him or distorted.

    ( 14)  the member should be moral character and serve as role models in his work and willing to sacrifice for the homeland and the people and  characterized by selfless integrity and honesty, courage and chivalry within the party and outside the

           The interests of the party to every interest, and struggling against all manifestations of vanity and self.

     15) that the struggle against all racial discrimination, national, religious or sectarian lines.

     16) to be ever vigilant about the machinations of enemies and ensures the security and integrity of the party and maintains secrets of the party.  

(*) Resolution of the Political Bureau at its meeting held on 15 .04.2008 to amend the text of Article IV (membership in the party)  by adding the following:

         As the right of every Iraqi men  and Iraqi women from  different nationalities and religions belonging to the party.  The article will be as follows:

))                The right of every Iraqi people  from Kurdish nationalism within the territory of Kurdistan and the outside as the right of every Iraqi men and women from different nationalities and religions, belonging to the party and be a (candidate member) if he fulfills the following conditions ((

     17) after given the honor of membership belonging to the ranks of the party by repeating the Section membership  in front of his charge and the members of his  organization and shall be in accordance with the following: 

)) I swear by Almighty God and my honor to be honest  and  faithful to the principles of the (Kurdistan Freedom and justice Party) in a conservative on its secrets  and a fighter in order to achieve its objectives in the unity of Iraq and the right of the Kurdish people in a free and dignified life .. God is my witness.))

Article V:

         Install Membership: 

                Extending the nomination period of one year candidate during the implementation of all missions assigned by the party and at the end of the nomination  the candidate  should present report  to fix its membership in the party, and  the organization (level) the highest in the meeting to study this request and should have had all the necessary information on the candidate and the extent of familiarity with the program of the party and rules of procedure of the political party line and study the characteristics of the candidate and the political process to take a decision on the admission of a candidate member of the ruling or after the acceptance of  the candidates and levels that are higher than that of its decision.

Article VI:  

        Duties of the member:  

1-         The member should fighting  firmly and sincerely to implement the Party's policy and decisions In order to achieve its near and far goals set forth in the documents.

2- performs the tasks assigned by the party.

3-operates in order to strengthen the party  sites in all segments of  people .

4- paying attention to  raising the level of political consciousness and absorb the party's policy and plan and expand public knowledge.

 5-abiding  by the rules of procedure and rules of the party organizational and respects the principle of party discipline. 

Article VII:  

            Dropping membership: 

Calling party membership in the following cases:

1) based on his desire to resign from the party for justified reasons.

2-If a tarnished the reputation of the Party and Iraq's reputation and the reputation of Kurdish nationalism.

3-for not complying with the rules of procedure and principles of the party and its goals, did not attend for more than three meetings without a legitimate excuse.

4-If deviated from the march of the party and the national policy.

5-If he has been more than three warnings.

6-If it is proved to belong to another party.

7-If the farm within the ranks of the party.

 8If the rule of a crime involving moral turpitude. 

 Article VIII:  

         The rights of a member of the party: 

1 contributing  in the debate of party policy and plan in the meetings of the party organization to which he belongs, has the right to exercise the principle of  criticism of  his  friends and the requests  to hold them accountable for their mistakes.

2- submitting to what he sees as useful suggestions for improving the Party's work both to the employing organization or of any level or (Organization) party is responsible under its supervision to the Central Committee.

3-to elect and be elected in the party under the conditions specified by the rules of procedure and regulations issued by the Electoral Central Committee.

4-has the right to take part in a debate in the party about the decision or sentence related to his activity and behavior.  

Article IX:

     Transmission Members:

                  The party  should inform the party organization to which  it belongs in the event of a change of residence or work place and the new place  transferred  and the organization  should  informing  the  high levels that are higher than this to secure contacted by the organization concerned.

Chapter III

Party-building and organizational principles

Article X:

  THE Party:  

 the  Party: It is the highest form of organization and built the organization of the party according to the following rules: 

1--Democratic centralism as the basic principle of Party building and its activities are practical and reflect in  the following principles:

A) a single center, leads all the Party organizations within and outside the province of Kurdistan.

B) Election of all levels of leadership in the party base to the summit, according to the electoral list established by the Central Committee on the following grounds:  

1-party elections are held at all levels from the base to the summit by direct secret vote.

2) -determine the percentage of representation in which all are equal members of the party.

3-) -confirm the right of every Companion to nominate himself or others, without the nomination of the higher levels.

4) -that the number of candidates for all levels of party more than the required number.  

C) provide levels of party periodic reports on its front organizations and front

Higher levels directly.

D) each level of the party, from the bottom  to the summit  should take decisions  by voting            and if there is a difference of opinion  the minority  should obligated  by majority decision

Article11 -

              Human levels of party:  

            For all levels of party and their organizations the right to take decisions and initiatives within its competence as long as the initiatives and its decisions do not conflict with decisions of the party and policy.  

Article Twelve:  

        Issues that have not taken a decision yet, it did not provide the documents that can be discussed freely in the meetings at the party entitled to such levels to raise their proposals thereon to the levels responsible for decision, or adopted by the Party.

Chapter IV 

Levels of the party 

Article XIII:  

         Levels of the party base to the summit of  Kurdistan Freedom and justice  party are (row - the group - the Commission - unequivocal - the Central Committee - The General Conference of the party) and party organizations are based on place of residence either professional offices on the basis of the profession.

Article XIV:  

 The levels of  the party members  are elected every three years, and these levels shall elect a secretary and vice president.  

Article Fifteen:  

         Level is the party responsible for his team to the highest level directly from him as well as before the general meeting of delegates elected by the levels of its affiliates.

Article Sixteen  

         In emergency situations is not possible to hold elections due appreciation of the Central Committee could be replaced by the principle of appointment in the levels of a particular party is an exception.  

Article XVII:  

         The levels of leadership in case of necessity to resolve the level of existing minimum it and replaced it, and requires the approval of top level (command top) are also entitled to levels of leadership to entice recruits to the levels below them that do not exceed the number of members joined half the level indicated otherwise must elect a new level .  

Article Eighteen:  

       If you lost a member of any level in the  party to exercise the level of activity at the level for more than four months without the knowledge of his organization's party may not return to the party, but a decision of his organization and with the consent of the highest level.  

Article Nineteen:  

       Where necessary in order to be of Party organizations at various levels in the field, supervised by the formation of organizations and levels of leadership operating under the direct leadership to tell the higher levels of them.     

Article Twenty:  

           The duties of party organization and levels of the lead:  

   the  Party organizations and all levels of leadership in the field of work the following duties:  

1  )  implement the resolutions of the Party and the leading  levels within the limits of their activity. For themselves the task of securing the application of the directives issued by the Party Politburo and Central Committee and its offices in all fields of intellectual activity, political and regulatory framework.

2 ) develop a program in the scope of work includes the tasks before the light of the party's plans, programs and studies to prepare the political, economic, social and pension demands of the masses in the field of activity and to propose solutions for them.

3) To solidify and expand the rules among all segments of society of workers, peasants, and intellectuals earners and professionals all.

4) The expansion and development of party cadres according to the requirements of party work.

5) development of the practice criticism and self-criticism and monitoring of implementation and education of Party members in a spirit of emphasis and vigilance about the shortcomings of the leakage of foreign elements in the party ranks and ensure the security and unity.

6) Attention to educate Party members through workshops, cultural and urged them to self-education and understanding of the plans of the party and its decisions and read the party newspaper, and his messages.

7) the application of the system of party discipline on all Party members and all levels.  

Grade : 

Article twenty-one:  

                         Grade:   Is the smallest organizational unit-level party and consists of each row of (7-10) of all confirmed members and candidates. Not entitled to candidates for membership to participate in the party elections nominations for membership of the top level (the group), but after you install the membership.  

Article XXII: 

                      Group:  

            Group in the Party of Freedom and Justice is the organization the main Kurdish party, which represents party base and, through the reflected and applied a policy of the party among the masses and through the party felt the pulse of the masses and works to defend their demands.  

            The group's treasurer is responsible for monitoring the activities of members of the group and follow-up implementation of decisions and the presence of members of the group for the meeting.

            The group has members from five to seven at the discretion of the group and its functions is the distribution of responsibilities on them. The group held regular meetings take into account the availability of a quorum.

Functions of group: 

1) to forge close ties with all segments of society.

2) the implementation of the Party's policies and goals.

3) raise the level of its members, political and cultural.

4) Education members in the spirit of party discipline and ensuring the security of the Party and the purity of its ranks, and the practice of criticism and self-criticism aimed at improving the activity of comrades and development and to be at the forefront of folks to defend the homeland and the people against imperialism and Zionism in the defense of the gains obtained by our Kurdish people through their long struggle    

The  commission

Article XXIII: 

       Authority is the party organization is responsible for a number of partisan groups in a particular area of partisan and is working under the supervision of firm directly. The Commission shall elect a secretary from among its members and the number of members of the Authority consists of (5-7) and by members of the Commission's work can increase the number.  

Functions of the Board:  

1) implementation of the Party's policy and the decisions of higher Party levels in the area of activity.

2) pay attention to the field of work in-depth study and identify various aspects of the activity, and especially the political struggle the national and national, social and economic development.

3) the struggle for the demands of the masses in all areas and to improve the level of their physical and cultural.

4) work to strengthen and expand the party and help (group level) in the party to organize its internal life and to absorb the party's policy and decisions and their implementation.

6) the establishment of relations of cooperation and common struggle with the national forces and with other national trade union organizations and agricultural professional .. etc..

Of Article XXIV: 

          Organizational level is a party in our party is responsible for the leadership of Party organizations in the lower area of operation (the body, the group, class) is responsible for the activity in front of the central committee and political bureau, told a meeting of delegates and elected representatives of the organizations in the General Conference.  

       Formed at the organizational level (categorical) levels, similar to the other party and elected as Secretary in consultation with the Bureau of political and organizational structure.

      Members are elected (categorical) once every three years in the election of delegates elected by its affiliated organizations.

       Categorical tasks:  

              the organizational level (categorical) plays an important and key role in the life of the party and its development, organization and implementation of its functions, in addition to the tasks listed in Article 20, it is the following tasks:

1) linking the party's policy positions, the concrete of the masses and found the necessary field work and learn about the various aspects of the national political life and national economic and social struggle and the conditions of the state programs and development projects and the progress of implementation and the various aspects of government activity and its relationship to people's interests and interest in the activity of intellectual and cultural ties of cooperation with the forces and national trends and nationalism.

2) continuing supervision of the work and activity of party members elected to the boards of local administrations, trade unions, associations, organizations and public associations and guidance.

3) constant contact with the party organizations and the minimum of its rules to monitor the progress of its work and study their positions and dissemination of experiences and successful initiatives and the creation of new cadres.

4) the development of financial resources and approval of the disbursement and supervision of the party newspaper and literature issued by the party.

5) make periodic reports about their activities and the conditions of their region of the Central Committee and Politburo.  

Chapter V  

Party organizations at higher

Article XXV 

                   national  conference of the Party:     

1) National Congress of the highest authority in the party and is held every two years at the invitation of the Central Committee.

2) consists of the National Congress Party General Secretary and members of the Politburo and Central Committee and the elected representatives of party organizations. The Committee may invite members of the Central Conference of party members, activists and specialists on the proportion that did not exceed 5% of the members of the Conference and the Conference of the right to convert them or some of the delegates to authentically if necessary.

Article Twenty-Six:  

                          Central Committee:  

1) The Central Committee is the organization senior leadership of the party in phase between the conferences and national develop policies of the party and lead his intellectual activity, political, national, national, organizational and governing its relations with the parties and forces and political organizations other and choose deputies to the parliament and ministers in the government and oversees the work and had the editorial boards of the press, the central and led and supervised and choose the leadership cadres of party organizations in the level of financial management firm and the party is  Responsible in front of the  National Conference of the Party and implement its decisions.

2) develop the Central Committee of an annual work plan for its activity.

3) elect the Central Committee of a political office is leading the Party's work between the conferences and be responsible to him.

4) Central Committee held every three months and involving candidates of the Central Committee in their meetings and have the right to debate and make suggestions and votes are advisory and the right of the Central Committee held its meeting without them.

5) determine the political bureau meeting time of the Central Committee and attend the agenda, the right of the Political Bureau and the Secretary-General to invite the Central Committee to meet as often as necessary, so can the Central Committee to hold a meeting at the request of one third of its members, stating the reasons for the contract.

6) the right of the Central Committee to be held once in a while the quality of the meetings called by representatives of the Party organizations and buddies from specialists. The right of the Central Committee to hold a general debate in the party on the issue of issues.

7) the right of the Central Committee when necessary inclusion of new members of the elected candidates at the party or others members of the party a majority of two thirds of its members.

Chapter VI  

Partisan offices

Article Twenty-Seven: 

                 Partisan offices: 

  The  Offices of the party formed by a decree of the Central Committee, namely:

1) Office of Management.

2) Office of Culture and the media.

3) Office of External Relations and national levels.

4) the Office of the students and young people.

5) Office of Tribal Affairs and faces social development.

6) Office of Professional.tasks

7) Office of Women's Affairs.

8) Office of Economic and Finance Affairs.

9) Office of military security Affairs.

First) Bureau of Management:

                Headed by a member of the Political Bureau and supported by two members of the Central Committee and staff developed

         That number not more than about 6 guys, and the work of the Bureau: is 

1) is to study the organization and methods of organizational work and how to develop and expand the organizational base of the party in the Kurdish community.

2) Study the political map of Iraqi parties and regional and other internal regulations and to study and compare the rules of procedure and the Platform Party and benefit from the development organization.

3) Office holds periodic meetings are set by the Bureau examined the organization and recommendations of the Political Bureau for consideration and approval.       

II) Office of Culture and Information: 

               Culture and Information has an important role in all activities of the Party's political, social, economic, cultural, military and security, which is the true face of the principles of the party and through it describes attitudes.  

               The office is a member of a political office and two members of the Central Committee and three members of staff with experience in advanced Information and Culture, are elected by the Politburo and Central Committee.

                 The mission of the Office:

1) prepare the necessary studies for the rehabilitation of party members and cadres to nominate the party's ideas in their minds.

2) development of cultural seminars for the party system.

3) follow all the local media, regional and international to get acquainted with their positions and views.

4) supervise the party's issues, cultural and media such as newspapers, magazines, radio channels and TV stations.

III) The Office of External Relations and National:  

                Manages the office, a member of the Politburo with a member of Central Committee members and a number of leading cadres of familiarity with foreign languages, and the Office's mission to find relationships and political ties with the national parties and parties in the regional countries and international development in the interests of our national, national and party interests. 

IV) The Office of Student and young people  

                 Bureau should consist of one member of the Politburo and the Central Committee with (3-5) members selected by the Central Committee who have the experience to work among the students and the young man to pose this segment of the wealth of patriotic and nationalistic serves the goals of the party and prepared for its responsibility to defend the national rights of our Kurdish people.

V) Office of Tribal Affairs and social: personalities:

               Manages the office, one member of the Politburo or Central Committee and the leadership cadres, the Office's mission to strengthen the relationship with the tribes, the Kurdish party and their heads and faces well-known social in the community to strengthen the relationship with them and broaden the base of the party ranks.  

VI) Office and Professional  tasks 

               Manages the office, one member of the Politburo or Central Committee and the leadership cadres, the task of the Bureau to organize social groups that belong to trade unions and associations of workers and farmers, engineers, doctors, accountants, auditors and geological .. Etc

 The Office of Women's Affairs: 

             A decision of the Central Committee headed by a member of a political office, assisted by a member of the Central Committee that not exceeding the number of officers of (7) including the head of the office. 

Tasks of the Office: 

1. Follow-up to the role of the Party and the feminist movements in the sector.

2. Work to raise the flag of women in society and raise their capacity and efficiency in all areas of life

3. Follow-up of Women's Affairs in the Kurdish and professional syndicate elections, legislative and support for effective participation in public life.

4. Follow-up activity of Kurdish women and work to develop its role locally and in regional and global forums.  

VIII) Office of Economic and Finance Affairs  

               The bureau's decision of the Central Committee and headed by a member of Political Bureau of the Central Committee and includes a number of leading cadres experienced high economic and financial. 

        Tasks of the Office:

1. Monitoring the implementation of the financial system of the party.

2. Development of financial resources of the party.

3. Participate in seminars and conferences domestic economic and financial, international and regional issues.

4. Preparation of reports, studies and research of economic and financial by subtracting the point of view of the party.         

IX) Office of military Security Affairs: 

                It is  responsible of the security of the party and its leadership, cadres and immunized from  the hostile elements and collection of information received from the device partisan about it.      

Chapter VII

Sanctions 

Article XXVIII

                    penalties            

            All members who do not follow the decisions of the Party Central Committee or break the party's rules of procedure and party discipline or neglect their duties, or not keeping  the secrets of the party or  not stand for the party or those who take advantage of the party for personal gains or family to take their right to sanctions by the party organizations to which they belong and they should abide out pending the decision by the Party organizations at higher levels.  

          The penalties are Alert - guidance notes - reprimands - pause for partisan action - forfeiture of membership -  firing - expulsion.  

          Penalties differed according to party level either expulsion is the maximum sentence is coupled with advertising and defamation, but for Central Committee members or candidate to or a member of the Oversight Committee is a sentence strip ended, dismissal or expulsion from the party with the consent of two thirds of the members of the Central Committee and announced the convening of the first national conference of the party .  

          The purpose of the punishment partisan  is treating the  errors and maintenance of the party when deciding dismissal or expulsion should be the commitment of most of prudence and the spirit of comradeship and thorough research of the accusations against party member and accountability should take place with his presence may not be firing epithets and accusations against him before the decision of dismissal or expulsion from the party. The right punishable by filing an objection to the decision to sentence the highest level are reviewed his request and communicated to the decision of the Investigative Committee on the top and be clear-cut decision  

Article XXIX:  

                        Oversight Committee:  

1) The Oversight Committee in coordination with the Political Bureau to implement the following functions:  

A- monitoring the implementation of the policy of the party and the application of rules of procedure at all levels of the Party.

B- Control of the party's finances, accounts and projects.

C- verification of compliance by members and candidates for membership of the party discipline and party to propose a sanction for the party members who violate the party's platform and rules of procedure and violating the system of party discipline.

D- consider the complaints of party members, including in relation to penalties him. 

2) provide the Oversight Committee recommendations and suggestions on the issues before it or researched

    By it to the Central Committee or its political bureau and them telling them that the actions taken     On these issues

3) the Oversight Committee PROVIDED  a report on its work to the National Convention.  

4) A member of the Oversight Committee should spent  ten years ago in the party he has no penalties in  the party 

5)  Oversight Committee shall elect a Chairman if elected by the Conference.  

Article Thirty: 

          Party's finances: 

              1) Financial resources of the party of the following:  

A - of government support in the controls supporting the parties under the applicable laws.

B - from the participation of members and allowances of belonging.

 c- from voluntary contributions.
